IMPORTANT LEGAL NOTICE

This is a binding legal agreement that affects your legal rights. By signing this agreement, you waive certain legal rights including the right to sue. Please read carefully and consult with an attorney if you have questions about your legal rights. This agreement is governed by Alaska state law.

Mandatory Documentation Required

All guests must complete and electronically sign our comprehensive Terms, Conditions & Liability Agreement before participating in any trip. This includes detailed participant information, medical disclosures, and acknowledgment of all risks and terms outlined below.

Medical and Health Disclosure Requirements

Medical Fitness Requirement: Participation requires that you be in adequate physical condition for wilderness activities including hiking, wading in rivers, and camping. You must disclose any medical conditions that could affect your safety or ability to participate.

Required Medical Information

  • Complete disclosure of all medical conditions, medications, or physical limitations
  • Swimming ability assessment (required for river safety)
  • Emergency contact information with phone numbers
  • Any allergies or dietary restrictions
Swimming Ability Requirement

River activities require basic water safety awareness. You must accurately disclose your swimming ability level as this affects safety protocols and equipment assignments.

Travel Insurance Requirements

MANDATORY TRAVEL INSURANCE

All participants must obtain comprehensive travel insurance that includes trip cancellation, trip interruption, and emergency medical evacuation coverage before departure.

Minimum Required Coverage

  • Trip cancellation/interruption: Minimum coverage equal to trip cost
  • Emergency medical evacuation: Minimum $100,000
  • Coverage for remote wilderness activities and helicopter evacuation
  • Coverage for pandemic-related cancellations (recommended)
Insurance Assistance Available

If you haven't purchased travel insurance yet, we will contact you within 48 hours of booking to help you obtain the required coverage. This is mandatory for all participants.

1. Booking and Reservations

All trips are booked on a first-come, first-served basis and are subject to prior booking commitments. Spaces may be filled unless you have called, reserved them, and secured your booking with the required deposit.

Group Size and Capacity Restrictions

  • We accommodate groups of 2 to 10 persons, depending upon the specific water you wish to visit
  • Togiak River trips: Limited to 6 guests by federal permit requirement
  • Goodnews and Kanektok River trips: Limited to 8 guests
  • Available spaces on all scheduled trips are subject to change based on permits and logistics

Single Anglers and Group Filling

Single anglers may inquire about joining existing trips. We maintain an email list for updates on open spaces. We reserve the right to fill any remaining spaces if your group size does not reach the maximum capacity for any particular trip.

2. Weight and Capacity Restrictions

STRICT WEIGHT LIMITS

All trips have weight limits of 250 pounds per person, including all personal gear and any equipment rented from us, due to aircraft capacity limitations.

While we will attempt to accommodate guests whenever possible, any additional capacity requirements may only be available at extra cost and cannot be guaranteed. Exceeding weight limits may result in additional charges or inability to participate.

Capacity Limitations by Location

  • Weight restrictions apply to combined passenger and baggage weight
  • Gear rental items count toward your weight allowance
  • Special equipment requests may require additional aircraft arrangements at extra cost

3. Payment Terms and No-Refund Policy

Deposit and Payment Requirements

  • A deposit of 50% of the total trip cost is required to confirm all bookings
  • Deposits are due within 15 days of requesting space on any trip
  • Reservations made within 60 days of departure require full payment at the time of booking
  • "Special offer" trips require full payment at the time of booking
  • Balance of trip payment is due by June 1 of your trip year

Payment Methods

  • Check or wire transfer (preferred methods)
  • Credit card payments may be subject to processing fees
STRICT NO-REFUND POLICY

Alaska Rainbow Adventures upholds a strict no-refund policy for any reason, including but not limited to illness, injury, travel delays, personal emergencies, weather-related disruptions, pandemics, natural disasters, or government restrictions.

Due to Alaska's extremely short fishing season and the advance commitments required for aircraft, guides, permits, and remote logistics, cancellations cannot be accommodated with refunds or rebooking.

Transfer Option: Participants may transfer their reserved spot to another qualified person who can participate in their place, subject to company approval and completion of all required documentation.

4. Aircraft Transportation and Third-Party Services

CRITICAL NOTICE

Air transportation services are provided by independent third-party charter operators and are NOT owned, operated, or controlled by Alaska Rainbow Adventures.

Alaska Rainbow Adventures is NOT Responsible For:

  • Flight delays, cancellations, or mechanical issues
  • Aircraft safety, maintenance, or pilot qualifications
  • Baggage loss or damage during air transport
  • Any incidents, accidents, or injuries occurring during air transport
  • Weather-related flight disruptions
  • Charter operator policies or procedures

All air transportation is subject to weather conditions, aircraft availability, and charter operator policies beyond our control.

5. Company Responsibility Limitations and Force Majeure

Alaska Rainbow Adventures is not responsible for any loss, damage, or injury to persons or property, however caused, including but not limited to costs of accommodations and associated services caused by:

  • Weather conditions and natural disasters
  • Transportation problems and aircraft issues
  • Government actions, regulations, or travel restrictions
  • Pandemics, epidemics, or health emergencies
  • Labor strikes or work stoppages
  • War, terrorism, or civil unrest
  • Equipment failure beyond our reasonable control
  • Acts of God or other events beyond Alaska Rainbow Adventures' control
  • Third-party service provider failures or issues

Trip Modifications and Cancellations

For safety or comfort reasons, we reserve the right to cancel or make reasonable schedule changes to all or portions of your trip without recourse. Force majeure events do not entitle guests to refunds, credits, or rebooking.

6. Services Included/Not Included & Legal Requirements

Services Included in Trip Cost

  • Round-trip air transportation from designated starting point
  • Comfortable tent camp accommodations while on the river
  • All meals during the trip (breakfast, lunch, dinner, snacks)
  • Professional guiding services
  • Life jackets and required safety equipment
  • Basic fishing safety instruction

Services NOT Included (Guest Responsibility)

  • Alaska fishing license and king salmon stamp (required by law)
  • Fishing tackle, rods, reels, flies, lures, and leader materials
  • Personal sleeping bags (rentals available in some locations)
  • Travel cancellation/interruption insurance (required)
  • Overnight accommodations and meals at starting/ending points
  • Gratuities and personal items
  • Alcoholic beverages (see alcohol policy)
  • Park fees, taxes, and permit fees
  • Personal equipment and clothing
ALASKA FISHING LICENSE REQUIREMENT

You MUST obtain an Alaska fishing license before your trip. Additionally, a king salmon stamp is required if you will be targeting king salmon. Failure to have valid licensing prohibits participation in fishing activities with no refund. Purchase at: www.adfg.alaska.gov

7. Alcohol and Responsible Use Policy

Alcohol Policy: Moderate consumption of alcoholic beverages by participants 21 years of age and older is permitted during designated times at camp. However, alcohol consumption is strictly prohibited during all fishing activities, while operating any equipment, or during any safety-sensitive activities.

Prohibited Activities While Under the Influence

  • All fishing and river activities
  • Operation of any equipment or watercraft
  • Participation in safety briefings or emergency procedures
  • Any activities requiring coordination or judgment
  • Interaction with aircraft or transportation services

Prescription Medications

Participants taking prescription medications must ensure adequate supply and inform guides of any medications that may affect judgment, balance, or reaction time.

Enforcement and Removal

Participants who violate this policy or whose alcohol consumption creates safety concerns may be removed from activities or the trip immediately without refund and at their own expense.

8. Acknowledgment of Risks and Dangers

WARNING - INHERENT RISKS

There are significant elements of risk in any adventure, sport or activity associated with the outdoors or wilderness, including but not limited to camping, climbing/hiking/trekking, fishing, hunting, walking on glaciated terrain or surfaces, and the presence or use of watercraft and other equipment.

Specific Risks Include But Are Not Limited To:

  • Falling, slipping on wet surfaces, and drowning
  • Cold weather and heat related injuries including hypothermia, frostbite, heat exhaustion, heat stroke, sun burn, and dehydration
  • Acts of nature including avalanche, rock fall, inclement weather, thunder and lightning, earthquakes, and volcanic activity
  • River crossings, portaging, and travel involving small aircraft
  • Equipment failure and/or operator error
  • Risks associated with animals including aggressive fish
  • Watercraft risks including capsizing, swamping or drowning
  • Attack or encounter with bears, moose, wolves, reptiles, insects, or other animals
  • Accidents or illness in remote places without immediate medical facilities
  • Fatigue, chill and/or dizziness which may diminish reaction time
  • Food-borne illness and contaminated water
  • Getting lost or separated from the group
  • Communication failures in remote areas
  • Emergency evacuation delays due to weather or logistics

Voluntary Assumption of Risk: I understand that unknown or unanticipated inherent risks may result in injury, illness, or death. I agree to assume and accept full responsibility for all inherent risks. My participation in this activity is purely voluntary.

9. Release, Waiver, and Hold Harmless Agreement

BINDING LEGAL WAIVER

In consideration for my fishing trip with Alaska Rainbow Adventures, I hereby RELEASE, WAIVE, DISCHARGE, and HOLD HARMLESS Alaska Rainbow Adventures, its owners, employees, agents, representatives, and assigns from any and all liability, claims, demands, actions and causes of action whatsoever arising out of or related to any loss, damage, illness, or injury that may be sustained by myself or to any property belonging to myself.

I VOLUNTARILY ASSUME FULL RESPONSIBILITY FOR ANY RISKS OF LOSS, PROPERTY DAMAGE OR PERSONAL INJURY that may be sustained as a result of being engaged in such activity.

I further hereby AGREE TO INDEMNIFY AND HOLD HARMLESS the RELEASEES from any loss, liability, damage or costs that may incur due to my participation in activities with Alaska Rainbow Adventures.

Scope of Release: This release includes claims that may arise from the negligence of Alaska Rainbow Adventures, but does not include claims arising from gross negligence or intentional misconduct.

10. Photography and Media Release

Alaska Rainbow Adventures may take photographs, videos, or other recordings during your trip for promotional, educational, or commercial purposes.

Media Usage Rights

Participants may choose to consent or decline media usage during the electronic agreement process. Consent includes:

  • Use of likeness, voice, and images for promotional materials
  • Website and social media usage
  • Brochures and marketing materials
  • Educational and commercial purposes

Non-consent Option: Participants who decline consent will not be included in group promotional photos when possible, and this choice does not affect trip participation.

11. Legal Provisions and Dispute Resolution

Governing Law and Jurisdiction

This agreement shall be construed in accordance with the laws of the State of Alaska. Any legal action arising from this agreement must be brought in Alaska state courts located in Anchorage, Alaska.

Dispute Resolution Process

  • Mediation: Before filing any lawsuit, the parties agree to attempt resolution through mediation in Alaska
  • Arbitration: If mediation fails, disputes will be resolved through binding arbitration in Alaska under the rules of the American Arbitration Association
  • Time Limitations: Any claim must be filed within one (1) year of the incident giving rise to the claim
  • Attorney Fees: The prevailing party in any legal proceeding shall be entitled to recover reasonable attorney fees and costs

Additional Legal Provisions

  • Severability: If any provision is held invalid, remaining provisions remain in full force
  • Integration Clause: This agreement constitutes the entire agreement between parties
  • Binding Effect: Agreement binds participants, heirs, assigns, and estate

12. Minor Participants and Guardian Requirements

Special Requirements for Minors

Participants under 18 years of age require parent or legal guardian signature on all agreements. Additional safety protocols and supervision requirements apply to minor participants.

Guardian Responsibilities

  • Complete electronic signature of all agreements
  • Provide detailed medical and emergency contact information
  • Ensure minor understands risks and safety requirements
  • Confirm minor's swimming ability and fitness level
Electronic Agreement Required

Upon booking a trip, all guests will be provided with an electronic version of this agreement to review and sign. The electronic agreement includes all terms and conditions outlined above and requires acknowledgment of risks, completion of participant information, and electronic signature before trip departure.
